Judicial Reform in Mongolia

NCSC completed the highly successful Mongolian Judicial Reform Program (JRP), funded by USAID, in 2009. The JRP has been the largest donor-funded contributor to Mongolia’s judicial reform efforts. After guiding Mongolian stakeholders through a process to develop a Strategic Plan for Reform of the Justice Sector, in 2000, NCSC provided more than eight years of technical assistance to implement the plan. In assisting in this transformation, NCSC followed a comprehensive approach, simultaneously:

  • recommending changes to the legal framework,
  • building training capacity,
  • raising ethical standards,
  • introducing modern court management practices,
  • And increasing public awareness about the workings of the justice system.

Over the course of the project, NCSC automated all courts in Mongolia as well as 23 prosecutor's offices. The rapid expansion and use of computer technology was a remarkable achievement given the vast expanse of the country.

JRP activities contributed to enormous increases in transparency and access to justice. Moreover, the Mongolian judiciary has improved its institutional coordination across the justice sector and utilized technology to improve court and prosecutor office performance.

  •  Enabled creation of an institution to provide continuing legal education to all legal professionals
  • Enabled a cadre of qualified adult education trainers
  • Built capacity and developed new methodologies for delivering adult education (video conferencing, Web-based e-learning applications, manuals and bench books)

 5.       Lawyer qualification

  • Helped develop and administer a lawyer qualification examination including drafting authorizing legislation
  • Assembled exam questions, develop a transparent and confidential process
  • Offered study tour to identify international best practices

 6.       Public education and ethics

  • Developed public outreach programs (television, radio, posters. flyers and public access terminals)
  • Offered training for journalists
  • Created surveys to measure changes in public perceptions
  • Assisted in drafting a revised Judicial Code of Ethics
  • Supported creation of a Judicial Disciplinary Committee Assessment
